REQUEST ARRAIGO

The arraigo consists of the ties that unite the foreign citizen with the place where he resides, whether for economic, social, family, work, academic or other reasons.

In this case, the foreign citizen in an irregular situation may request residence in Spain in accordance with the ties that he has developed in Spanish territory.

For this reason, we can find 4 types of Arraigos:

  • Arraigo Familiar
  • Arraigo Laboral
  • Arraigo Social
  • Arraigo para la formación.

We will go on to study each of these in the following sections.

REQUEST ARRAIGO FAMILIAR

Arraigo Familiar is a temporary residence permit for exceptional circumstances granted to foreign citizens residing in Spain and provided that you are in one of these situations:

  • If you are the father or mother of a minor of Spanish nationality with whom you live, or if you do not live, you are aware of your parental obligations. You can also apply for it if you provide support to a disabled family member of Spanish nationality for the exercise of his or her legal capacity, provided that you are in charge of and live with that disabled person.
  • If you are a spouse or recognized common-law partner of a Spanish citizen.
  • If you are an ascendant over 65 years of age, or under 65 years of age in charge, a descendant under 21 years of age, or over 21 years of age in charge, of a Spanish citizen, or of his or her spouse or common-law partner.
  • When it comes to children of a father or mother originally Spanish.

Arraigo Familiar requirements

To apply for Arraigo Familiar, you must meet the following requirements:

  1. Not be a citizen of a state of EU or family member to whom the community regime may apply.
  2. Not have a criminal record in Spain.
  3. Not be prohibited from entering Spanish territory and not be listed as rejectable.
  4. Be outside the period of commitment not to return to Spain.
  5. Be in any of the situations described in the previous section.

Step-by-Step: Request Arraigo Familiar

  • - First you must gather the documents to present your application, namely:
    • o Model EX10.
    • o Complete copy of passport with a minimum validity of 4 months
    • o Certificate of no criminal record.
    • o Proof of Arraigo Familiar:
      • In the case of the father or mother of a Spanish minor or a minor from the European Union
        • Birth certificate of the minor
        • Documents proving that they are up to date with their parental obligations
      • In the case of a family member of a Spanish citizen, prove the family link or the relationship of economic dependency.
      • In the case of a child of a Spanish father or mother:
        • Birth certificate of the applicant and the Spanish parent
        • Cohabitation with the minor or being up to date with parental obligations.
  • - Then you must submit the application to the Immigration Office where you reside, providing the documents described above and having paid the fee.
  • - The procedure can be carried out in person or online, this being the best option since it is very complicated to obtain an appointment to attend the Office.

APPLY FOR ARRAIGO LABORAL

Arraigo Laboral offers you the possibility of obtaining a temporary residence permit if you have been residing in Spain continuously for at least 2 years and if you have worked for a minimum of 6 months.

Arraigo Laboral Requirements

To apply for Arraigo Laboral, you must meet the following requirements:

  1. Not be a citizen of an EU state or a family member to whom the community regime may apply.
  2. Not have a criminal record in Spain.
  3. Not be prohibited from entering Spanish territory and not appear as a rejectable.
  4. Be outside the period of commitment not to return to Spain.
  5. Have remained in Spain for a minimum period of 2 years.
  6. Be able to justify the existence of employment relationships of no less than 6 months.

Importance of residing in Spain for 2 years

It is very important to provide documentary evidence that you have remained in Spain for 2 years continuously and without absences exceeding 90 days.

Proof of the employment relationship

To prove the employment relationship, you must present any evidence that demonstrates the existence of a previous employment relationship carried out in a legal situation of stay or residence. This may include documents proving continuous work activity for at least 6 months, either as an employee with a minimum of 30 hours a week for 6 months or 15 hours a week for one year, or as a self-employed person with continuous activity for at least 6 months.

You will also need to prove that you do not have a criminal record in your country of origin or in any country where you have resided in the last 5 years.

Remember that this permit is only available to people who are in an irregular situation in Spain. Therefore, if you have an application for International Protection in progress, for example, you will not be able to access this authorization.

I want to apply for Arraigo Laboral, what do I have to do?

First you must prepare all the documents:

  • Form EX10.
  • Complete copy of passport with a minimum validity of 4 months
  • Certificate of no criminal record.
  • Documentation proving continuous residence of 2 years in Spain
  • Documentation proving the existence of an employment relationship.

Then you must submit the application to the Immigration Office where you reside, providing the documents described above and having paid the fee.

APPLY FOR ARRAIGO SOCIAL

Another of the most well-known arraigo in Spain is the Arraigo Social. This permit is granted to those people who have resided in Spain continuously for at least 3 years and provided that you meet one of the following conditions:

  • If you have your own financial means or those of a family member.
  • If you plan to establish your own company.
  • If you have a job offer that guarantees at least the minimum interprofessional salary or the salary established in the collective agreement applicable at the time of the application.

Requirements for Arraigo Social

To apply for Arraigo Social, you must meet the following Requirements:

  1. Not be a citizen of an EU state or a family member to whom the community regime may apply.
  2. Not have a criminal record in Spain.
  3. Not be prohibited from entering Spanish territory and not be listed as rejectable.
  4. Be outside the period of commitment not to return to Spain.
  5. Have remained in Spain for a minimum period of 3 years. Absences cannot exceed 120 days.
  6. You must be able to prove family ties with other foreign residents or with Spaniards, or prove it with a social integration report issued by the Autonomous Community in which you are located.
  7. You must prove one of the following cases:
    1. If you have your own financial means or those of a family member.
    2. If you plan to set up your own company.
    3. If you have a job offer that guarantees at least the minimum interprofessional wage or the salary established in the collective agreement applicable at the time of the application.

I have a job offer. Is this enough to apply for Arraigo Social?

The job offer must represent a weekly workday of no less than 30 hours in total and guarantee at least the minimum interprofessional wage.

In addition, the contract may have a minimum duration of 20 hours in cases where you have minors or people who require support measures for the exercise of their legal capacity.

In some specific cases, multiple employment contracts may be presented, such as in the agricultural sector or when you work for several employers part-time and simultaneously in the same or different occupation.

I want to apply for Arraigo Social, what do I have to do?

First you must prepare all the documents:

  • - Model EX10.
  • - Complete copy of passport with a minimum validity of 4 months
  • - Certificate of no criminal record.
  • - Documentation proving continuous residence of 3 years in Spain
  • - Documentation proving the required family ties or report of social integration.
  • - Documentation proving means of livelihood
  • - Documentation proving job offer:
    • Employment contract
    • Copy of NIF and company deeds.
    • Professional qualifications required to carry out the profession.
    • Accreditation of the company's solvency.

You must then submit the application to the Immigration Office where you reside, providing the documents described above and having paid the fee.

REQUEST ARRAIGO PARA LA FORMACION

This arraigo was introduced in the reform of said regulation and came into force on August 16, 2022.

If you have been in Spain continuously for at least 2 years, you can obtain a residence permit for 12 months.

Requirements for Arraigo para la Formación

To request Arraigo para la Formación you must meet the following requirements:

  1. Not be a citizen of an EU state or a family member to whom the community regime may apply.
  2. Not have a criminal record in Spain.
  3. Not be prohibited from entering Spanish territory and not be listed as rejectable.
  4. Be outside the period of commitment not to return to Spain.
  5. Have remained in Spain for a minimum period of 2 years prior to the request for the authorization. Absences cannot exceed 90 days.
  6. You must commit to undergoing regulated training for employment or to obtain a professional certificate, or training that leads to obtaining the certification of technical aptitude or professional qualification necessary to exercise a specific occupation.
  7. You can also commit to continuing education at universities, taking courses to expand or update training or professional skills and abilities, as well as other teachings specific to continuing education.
  8. You must enroll within 3 months following notification of the resolution granting the residence permit. Otherwise, the Immigration Office may terminate said authorization. If registration is subject to specific periods, you must send proof of registration to the Immigration Office within 3 months after the end of said period.

I want to apply for Arraigo para la Formación, what should I do?
